Pennsylvania adopted RUFADAA at 20 Pa.C.S. Chapter 39, giving fiduciaries the ability to access digital assets — but only when the will authorizes it.

Three-tier priority

(1) Online tool by the user (Facebook Legacy Contact, Google Inactive Account Manager); (2) the will; (3) the provider's terms of service.

Modern will language

A complete will grants the executor authority over digital assets, online accounts, communications content, and cryptocurrency.

Cryptocurrency

Self-custodied crypto is uniquely fragile — without keys, the executor cannot recover it. Document key location in a side memorandum, not the will itself.
