Using a PA POA for Real Estate

When a POA agent signs a deed or mortgage in Pennsylvania, the POA itself must usually be recorded along with the deed at the county recorder of deeds.
Recording requirement
21 P.S. § 351 governs. Title insurers will not issue a clean policy without the POA in the chain of title.
Agent certification
Most title companies require a fresh agent certification dated within 30–60 days of closing, confirming the POA has not been revoked and the principal still lives.
Lender requirements
Fannie/Freddie loans have additional POA requirements — call the lender's counsel before closing day.
