Pennsylvania Guardianship & Incapacity FAQ

Guardianship in Pennsylvania — how the petition works, what it costs, and how most families avoid needing it at all.

Guardianship is what happens when an adult can no longer make decisions and no valid power of attorney exists. It is a court proceeding under 20 Pa.C.S. Chapter 55, decided by the Orphans' Court in the county where the person lives.

It works, but it is public, adversarial in form, and expensive to start and maintain. Almost every guardianship I see could have been prevented by a $400 set of documents signed a few years earlier.
